Modernization of the Environmental Law of the Russian Federation and Import of Institutions: Economic-Legal Analysis
Abstract
The authors study the changes in Russian mechanism of environmental protection entered by the new resource and environmental law projects, with the focus on environmental regulation measures and the corresponding economic motivation. Th ey attempt to test to what extent the proposed measures conform to the law and economic theory. Furthermore, they suggest some recommendations for successful implementation of administrative reforms and for efficient realization of responsibility principles concerning environmental damage due to the actions of economic agents. So far, the measures to be now applied in Russia have been successfully implemented in the transformation of the EU to apply the best available technologies. Therefore, the authors analyze the necessary preconditions for successful transfer of this institutional system to the Russian reality.
